Warranty Instructions

  • Warranty service applies to products purchased directly from UpToke, LLC.
  • Any warranty claims for purchases made through a retail store or third party must be processed through the retail store of purchase or applicable third party.

    Limited Warranty Details

    UpToke offers:

    (a) 5 year limited warranty on materials and workmanship

    (b) 1 year battery warranty

    UpToke, LLC warrants Spyre against defects in materials and workmanship under normal use for a period of five (5) years from the date of retail purchase for the original purchaser, having purchased directly from UpToke LLC.  If a physical defect arises and a claim is received within the Warranty Period, then UpToke, at their sole discretion and to the extent permitted by law, shall either (1) Repair the product defect, (2) Exchange the product with a product that is new or functionally equivalent, or (3) Refund the purchase price of the product.

    The Limited Warranty excludes normal performance degradation of batteries, neglecting to adhere to cleaning instructions, scratches or other cosmetic damage, and damage apparently caused by misuse.*

    The Warranty is only serviceable in the USA and Canada.

     

    Exclusions and Limitations

    The Limited Warranty applies only to products manufactured by UpToke LLC that can be identified by UpToke Warranty Service to be purchased at an authorized retailer, serviced by an authorized UpToke distributor, or purchased directly from UpToke.  For questions regarding authorized retailers, please contact us at Info@UpToke.net.

    The Limited Warranty does not apply to any products which cannot be identified as a product manufactured by UpToke.

    *The warranty does not apply to (a) damage caused by accident, abuse, misuse, flood, fire, earthquake, acts of piracy, or other external causes; (b) damage caused by operating the product outside the permitted or intended use as described by UpToke; (c) a product or part that has been modified to alter functionality or capability; (d) cosmetic damage, including but not limited to scratches, dents, and broken plastic.

    Important: Warranty applies to original end-user purchaser only and is non-transferable. Warranty claims for purchases made through an authorized reseller or distributor must be processed through the authorized reseller or distributor of purchase.  Intentionally opening or disassembling your device in any way will void your warranty.

     

    Unauthorized Products

    The prevention of unauthorized sales and counterfeiting is a concern of UpToke.  The reduction of such practices is the objective of UpToke.  Customers are advised to be cautious when purchasing devices from unauthorized resellers as the quality, reliability and safety of these products is uncertain and in some cases, may expose the user to serious dangers not encountered with genuine UpToke products.

    UpToke actively pursues and investigates unauthorized resellers and counterfeiters in an effort to protect customers and business partners. By finding counterfeiters and taking legal action against them, we are doing our part to reduce this problem in the marketplace.

    UpToke recognizes the disappointment a consumer feels upon learning that they are a victim of counterfeiting.  UpToke regrets that the Company is not able to reimburse or warrant the purchase of any product that is not an authentic UpToke product and purchased from UpToke or an authorized dealer.

    UpToke does not intervene in the resolution of disputes, including assistance with PayPal or credit card refunds.
